These Terms of Service (“Terms”) govern your use of the Circle M Pecan Farm website and your purchase of our products. By using our site or placing an order, you agree to these Terms.
Products and availability
We try to describe our products and display pricing and stock accurately, but we cannot guarantee that all information is error-free or that items will always be in stock. We may correct errors, change products, or update prices at any time. If an item becomes unavailable after you order, we will contact you and issue a refund for that item.
Pricing, payment, and tax
Prices are in U.S. dollars. Payment is processed securely by Stripe; by checking out, you agree to Stripe’s terms. Applicable sales tax is calculated at checkout based on your delivery address. We reserve the right to refuse or cancel any order, including orders that appear fraudulent or that we cannot lawfully fulfill.
Shipping and local pickup
Pecan wood products and whole in-shell pecans ship nationwide within the United States. Our other pecan foods (cracked, shelled, and candied) ship within Texas only, in keeping with Texas cottage food law. Free local pickup is available in Rosenberg, TX. See our Shipping & Returns page for full details. If a food order is placed for delivery outside Texas, we will cancel and refund that order.
Cottage food notice
Certain food items are made in a home kitchen that is not inspected by the Department of State Health Services or a local health department. These items are produced under the Texas Cottage Food Law.
Allergen notice
Our products contain or are produced in a kitchen that handles tree nuts (pecans). If you have a food allergy, please order with caution.
Intellectual property
All content on this site — including text, logos, and images — is owned by or licensed to Circle M Pecan Farm and may not be used without our permission.
Disclaimers and limitation of liability
Our products and website are provided “as is” to the fullest extent permitted by law. We are not liable for indirect, incidental, or consequential damages arising from your use of the site or our products. Nothing in these Terms limits any rights you have that cannot be waived under applicable law.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any disputes will be handled in the state or federal courts located in Fort Bend County, Texas.
Changes to these Terms
We may update these Terms from time to time. Continued use of the site after changes means you accept the updated Terms.
